GENERAL CONDITIONS OF SALE
The General Conditions of Sale concern the purchase of products distributed by Samples Divise. Each purchase transaction will be governed by the provisions of Legislative Decree 185/99 and, as regards the protection of confidentiality, will be subject to the legislation pursuant to Legislative Decree no. 196/03 (discussed in the specific section reserved for the Protection of Privacy).
ORDER ACCEPTANCE / CONCLUSION OF THE CONTRACT
By sending the order online, the Customer sends Samples Divise a proposal to purchase the product and/or products added to the cart. When the Customer places an order online, he agrees to purchase them at the price and terms indicated in these General Terms and Conditions of Sale. After making the payment, the order can no longer be cancelled.
CUSTOMER COMMITMENTS
These General Conditions of Sale must be examined online by Customers before sending their orders. The forwarding of the order therefore implies their full knowledge and their full acceptance. Once the online purchase procedure has been completed, the Customer undertakes and undertakes to print and keep these general conditions of sale, which have already been viewed and accepted during the purchase process, in order to completely satisfy the condition referred to in articles 3 and 4 of Legislative Decree no. 185/1999.
PRICES
All prices on the site include VAT. The prices shown on this site are the sales prices currently in force.
PAYMENTS
Payment for the products purchased and the related shipping costs must be made by the customer when placing the order using one of the methods available and indicated online in the relative “Payment Methods” section. In the case of a bank transfer, Samples Divise will process the order upon receipt of the transfer.
DELIVERIES
In case of acceptance of the order, it should be noted that: the goods will be delivered via a home courier service. Shipping means the delivery of the goods to the courier. The delivery times described during the purchase process on the site depend on the shipping method used. The courier will deliver the goods only with a signature confirming receipt of the same.
RIGHT OF WITHDRAWAL
Pursuant to art. 5 DL 185/1999, if the Customer is a consumer (i.e. a natural person who purchases goods for purposes not related to his business or professional activity), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. To exercise this right, the customer must contact Samples Divise via the e-mail address indicated in the contact section of this site. The aforementioned communication must be made within ten (10) days of receipt of the goods; the costs incurred for the shipment alone remain the responsibility of the Customer. If the right of withdrawal is exercised in accordance with the previous conditions, Samples Divise is required to reimburse the sums paid by the customer no later than 10 days from the day on which the same was informed of the intention to withdraw, provided that Samples Divise has already received the return of the goods or that the Customer provides proof that he has already shipped the goods. Samples Divise will use for the re-credit the same means of payment used for the transaction, unless an alternative method is requested.
IMPORTANT
the customer must apply the label he receives attached to the transport documents to the outer packaging of the return, where he must transcribe the information received. As the only charge, and if the error is not due to a fact attributable to Samples Divise, the Customer will have to bear the costs of returning the goods. The goods must be returned intact and in the original packaging, complete with all its parts and without having suffered any damage. Upon arrival at the warehouse, the goods will be examined and, in the presence of damage or tampering, the withdrawal cannot be exercised.
COMPLAINTS
Any complaint must be addressed directly to Samples Divise by e-mail to the address indicated on the site. Samples Divise undertakes to respond to complaints within five working days. Should you happen to receive a defective item, please contact us at: info@samplesdivise.it explaining what the problem is and attaching a photo within ten days of receiving the goods. In the event we find an actual defect or defect in the goods, we will send you the same item with the shipping costs at our expense. If the same item purchased is not available, the amount paid will be refunded as soon as possible.
APPLICABLE LAW AND JURISDICTION
The sales contract between the customer and Samples Divise is understood to be concluded in Italy and governed by Italian law. For disputes arising from the interpretation and execution of these Conditions, the Court of Rome will have exclusive jurisdiction, without prejudice to the provisions of mandatory laws.
